BRAINPACK ACCEPTABLE USE POLICY (AUP)

Effective Date: 1st July 2026

This Acceptable Use Policy ("AUP") forms part of the BrainPack Master Terms of Service and applies to all users, customers, administrators, authorized users, contractors, agents, affiliates, and any other persons accessing or using the Services.

Capitalized terms not defined herein shall have the meanings assigned to them in the BrainPack Master Terms of Service.

 

1. PURPOSE

The purpose of this AUP is to:

  • protect the integrity of the Services;
  • protect BrainPack infrastructure;
  • protect users and customers;
  • comply with applicable laws;
  • prevent abuse of Artificial Intelligence technologies;
  • maintain security and reliability.

Compliance with this AUP is a condition of using the Services.

 

2. GENERAL OBLIGATION

Customer shall use the Services only:

(a) in accordance with applicable laws;
(b) in accordance with the Terms;
(c) for legitimate business purposes;
(d) in a manner that does not harm BrainPack, other customers, third parties, or the Services.

 

3. ILLEGAL ACTIVITIES

Customer shall not use the Services to:

  • violate applicable law;
  • facilitate criminal activity;
  • facilitate fraud;
  • facilitate money laundering;
  • facilitate bribery or corruption;
  • facilitate tax evasion;
  • facilitate sanctions violations;
  • facilitate terrorism financing;
  • engage in unlawful surveillance;
  • violate court orders or regulatory requirements.

 

4. FRAUDULENT AND DECEPTIVE ACTIVITIES

Customer shall not:

  • impersonate any person or entity;
  • misrepresent identity;
  • create false accounts;
  • create misleading content;
  • engage in phishing;
  • engage in scams;
  • distribute fraudulent information;
  • mislead consumers;
  • falsify records;
  • falsify transactions.

 

5. INTELLECTUAL PROPERTY VIOLATIONS

Customer shall not:

  • • infringe copyrights;
  • • infringe trademarks;
  • • infringe patents;
  • • infringe trade secrets;
  • violate license agreements;
  • distribute unauthorized content;
  • remove copyright notices;
  • claim ownership of third-party materials.

Customer remains solely responsible for all content uploaded or generated through the Services.

 

6. MALWARE AND SECURITY VIOLATIONS

Customer shall not:

  • upload malware;
  • upload ransomware;
  • upload spyware;
  • upload viruses;
  • upload worms;
  • upload trojans;
  • deploy malicious code;
  • deploy backdoors;
  • deploy credential theft tools;
  • distribute harmful software.

Customer shall not use the Services to:

  • compromise systems;
  • gain unauthorized access;
  • interfere with security controls;
  • bypass authentication;
  • bypass access restrictions;
  • attack third-party systems.


7. NETWORK ABUSE

Customer shall not:

  • perform denial-of-service attacks;
  • perform distributed denial-of-service attacks;
  • conduct network flooding;
  • conduct packet attacks;
  • overload systems;
  • intentionally degrade performance;
  • interfere with infrastructure.

 

8. UNAUTHORIZED ACCESS

Customer shall not:

  • access accounts belonging to others;
  • attempt unauthorized access;
  • exploit vulnerabilities;
  • probe security controls;
  • conduct penetration testing without prior written authorization from BrainPack;
  • access restricted areas of the Services.

 

9. SCRAPING AND AUTOMATED EXTRACTION

Customer shall not:

  • scrape the Services;
  • harvest information;
  • extract databases;
  • copy substantial portions of content;
  • circumvent rate limits;
  • use bots for unauthorized extraction;
  • perform bulk collection of information.

Unless expressly authorized in writing by BrainPack.

 

10. REVERSE ENGINEERING

Customer shall not:

  • reverse engineer;
  • decompile;
  • disassemble;
  • decode;
  • reconstruct;
  • derive source code from;
  • attempt to discover algorithms underlying;

the Services, software, AI models, APIs, workflows, databases, or infrastructure.

To the maximum extent permitted by law, any statutory rights permitting reverse engineering are hereby waived.

 

11. AI ABUSE

Customer shall not use AI Services to:

  • generate unlawful content;
  • generate fraudulent content;
  • generate deceptive content;
  • generate malicious code;
  • generate phishing campaigns;
  • generate malware;
  • generate impersonation content;
  • generate disinformation campaigns;
  • automate unlawful conduct.

 

12. AI MODEL PROTECTION

Customer shall not:

  • extract training data;
  • attempt model inversion;
  • attempt prompt extraction;
  • attempt system prompt extraction;
  • attempt model replication;
  • benchmark models for competitive purposes without authorization;
  • develop competing AI models using the Services.

 

13. SPAM AND UNSOLICITED COMMUNICATIONS

Customer shall not:

  • send spam;
  • send bulk unsolicited communications;
  • send unlawful marketing communications;
  • violate anti-spam laws;
  • conduct automated messaging campaigns without lawful basis.

Customer remains solely responsible for obtaining all required consents.

 

14. SENSITIVE DATA

Unless expressly authorized by BrainPack in writing, Customer shall not submit:

  • classified government information;
  • state secrets;
  • military secrets;
  • intelligence information;
  • nuclear information;
  • controlled defense information.

Customer remains solely responsible for determining whether information is appropriate for processing through the Services.

 

15. HIGH-RISK USE CASES

Unless expressly approved in writing, the Services shall not be used as the sole basis for decisions involving:

  • life support systems;
  • emergency response systems;
  • critical infrastructure;
  • weapons systems;
  • air traffic control;
  • autonomous vehicles;
  • medical diagnosis;
  • medical treatment decisions;
  • nuclear facilities.

Human review shall remain mandatory.

 

16. HARASSMENT AND ABUSIVE CONTENT

Customer shall not use the Services to:

  • harass individuals;
  • threaten individuals;
  • intimidate individuals;
  • stalk individuals;
  • promote violence;
  • encourage violence;
  • encourage unlawful conduct.

 

17. PRIVACY VIOLATIONS

Customer shall not:

  • unlawfully collect Personal Data;
  • unlawfully disclose Personal Data;
  • process Personal Data without lawful basis;
  • violate privacy laws;
  • violate confidentiality obligations.

Customer remains solely responsible for compliance with applicable privacy laws.

 

18. EXPORT CONTROL AND SANCTIONS

Customer shall not use the Services:

  • in violation of export control laws;
  • in violation of sanctions regulations;
  • in prohibited jurisdictions;
  • for sanctioned parties.

 

19. RESOURCE ABUSE

Customer shall not:

  • consume excessive resources;
  • abuse AI credits;
  • abuse API limits;
  • circumvent quotas;
  • circumvent billing controls;
  • create excessive load.

BrainPack may impose technical limitations to protect system stability.

 

20. MONITORING AND ENFORCEMENT

BrainPack may monitor usage of the Services for:

  • security;
  • abuse prevention;
  • fraud detection;
  • compliance;
  • system stability.

Monitoring may be automated and may utilize AI systems.

 

21. INVESTIGATION RIGHTS

BrainPack may investigate suspected violations of this AUP.

Customer shall cooperate with reasonable investigations.

Failure to cooperate may constitute a material breach of the Terms.

 

22. ENFORCEMENT ACTIONS

Where BrainPack reasonably believes that a violation has occurred, BrainPack may:

  • issue warnings;
  • suspend access;
  • restrict functionality;
  • remove content;
  • disable accounts;
  • terminate Services;
  • report conduct to authorities;
  • pursue legal remedies.

BrainPack shall have no liability arising from enforcement actions undertaken in good faith.

 

23. REPORTING VIOLATIONS

Suspected violations may be reported through contact methods designated by BrainPack.

BrainPack may investigate reported violations but is not obligated to take any specific action.

 

24. CHANGES TO THIS AUP

BrainPack may modify this AUP at any time.

Updated versions shall become effective upon publication or as otherwise communicated by BrainPack.

Continued use of the Services following modification constitutes acceptance of the revised AUP.

 

25. ORDER OF PRECEDENCE

In the event of conflict between this AUP and the Master Terms of Service, the Master Terms of Service shall prevail except with respect to prohibited conduct expressly addressed in this AUP.

 

26. GOVERNING LAW AND JURISDICTION

This AUP shall be governed by the laws of the Republic of Cyprus.

Any dispute arising from this AUP shall be subject to the exclusive jurisdiction of the courts of Cyprus.

 

FINAL ACKNOWLEDGEMENT

By accessing or using the Services, Customer acknowledges that it has read, understood, and agreed to comply with this Acceptable Use Policy.

Customer further acknowledges that BrainPack may utilize Artificial Intelligence, Large Language Models, Generative AI technologies, current and future AI providers, automated monitoring systems, and global infrastructure in connection with the Services and enforcement of this AUP.
