BRAINPACK AI PROCESSING & AI GOVERNANCE NOTICE

Enterprise AI Transparency, Governance and Processing Framework

 

1. PURPOSE

This AI Processing & AI Governance Notice ("AI Notice") describes how BrainPackutilizes Artificial Intelligence technologies in connection with its Services.

This AI Notice is intended to:

  • promote transparency;
  • establish governance principles;
  • describe AI processing activities;
  • describe customer responsibilities;
  • describe BrainPack's rights regarding AI technologies;
  • support compliance efforts under emerging AI regulations.

This AI Notice forms part of the BrainPack legal framework and shall be read together with:

  • Master Terms of Service;
  • Privacy Policy;
  • Data Processing Agreement;
  • Acceptable Use Policy;
  • Subscription Terms.

 

2. SCOPE

This AI Notice applies to all BrainPack Services that utilize:

  • Artificial Intelligence;
  • Machine Learning;
  • Large Language Models ("LLMs");
  • Generative AI;
  • AI Agents;
  • Predictive Systems;
  • Recommendation Systems;
  • Retrieval-Augmented Generation ("RAG");
  • Autonomous Workflows;
  • Future AI Technologies.

 

3. AI GOVERNANCE PRINCIPLES

BrainPack is committed to operating AI-enabled Services in accordance with the following principles:

Security

Protection of information and systems.

Transparency

Clear disclosure regarding AI usage.

Human Oversight

Appropriate human review where required.

Continuous Improvement

Ongoing enhancement of AI capabilities.

Responsible Innovation

Development and deployment of AI technologies in a commercially responsible manner.

Legal Compliance

Reasonable efforts to comply with applicable laws and regulations.

 

4. AI TECHNOLOGIES

BrainPack may utilize:

  • proprietary AI systems;
  • third-party AI systems;
  • open-source AI systems;
  • commercial AI systems;
  • future AI technologies.

BrainPack may integrate any current or future:

  • LLM;
  • foundation model;
  • multimodal model;
  • agent framework;
  • machine learning model;
  • orchestration platform;
  • inference platform.

 

5. AI PROVIDERS

BrainPack may engage one or more AI providers at any time.

Such providers may include:

  • model providers;
  • cloud AI providers;
  • inference providers;
  • embedding providers;
  • vector database providers;
  • agent providers;
  • future AI providers.

BrainPack reserves the unrestricted right to:

  • add providers;
  • replace providers;
  • remove providers;
  • modify providers;
  • change providers;

at any time and without notice.

BrainPack shall have no obligation to identify specific AI providers publicly unless required by applicable law.

 

6. CUSTOMER INPUTS

Customer may submit:

  • prompts;
  • instructions;
  • requests;
  • documents;
  • files;
  • communications;
  • CRM records;
  • ERP records;
  • operational information;
  • business information;
  • structured data;
  • unstructured data.

Such information may be processed through AI-enabled systems.

Customer remains solely responsible for all submitted information.

 

7. AI PROCESSING ACTIVITIES

BrainPack may utilize AI technologies for purposes including:

  • content generation;
  • text generation;
  • summarization;
  • classification;
  • extraction;
  • translation;
  • workflow automation;
  • reporting;
  • forecasting;
  • recommendations;
  • search;
  • analytics;
  • customer support;
  • software development assistance;
  • operational automation;
  • productivity enhancement.

Additional AI use cases may be introduced at any time.

 

8. AI OUTPUT

AI systems may generate:

  • text;
  • reports;
  • recommendations;
  • summaries;
  • analyses;
  • code;
  • images;
  • workflows;
  • communications;
  • insights;
  • forecasts.

All such content constitutes "AI Output."

 

9. AI OUTPUT LIMITATIONS

Customer acknowledges that AI Output may:

  • be inaccurate;
  • be incomplete;
  • be outdated;
  • contain errors;
  • contain hallucinations;
  • contain biases;
  • omit relevant information;
  • conflict with professional standards.

AI Output is inherently probabilistic.

BrainPack does not guarantee:

  • accuracy;
  • completeness;
  • originality;
  • reliability;
  • legality;
  • suitability.

 

10. HUMAN REVIEW REQUIREMENT

Customer remains solely responsible for reviewing, validating, and approving AI Output before:

  • publication;
  • implementation;
  • distribution;
  • customer communication;
  • regulatory use;
  • operational use.

Customer shall not rely exclusively upon AI Output.

 

11. HIGH-RISK USES

Unless expressly approved by BrainPack in writing, AI Services shall not be used as the sole basis for:

  • medical decisions;
  • medical treatment;
  • legal advice;
  • financial advice;
  • investment decisions;
  • critical infrastructure decisions;
  • emergency response;
  • weapons systems;
  • life-support systems;
  • public safety decisions.

Human review remains mandatory.

 

12. AI AGENTS

BrainPack may offer AI Agents capable of:

  • executing workflows;
  • performing tasks;
  • interacting with systems;
  • retrieving information;
  • generating outputs;
  • automating processes.

Customer acknowledges that autonomous systems involve additional risks.

Customer remains responsible for actions initiated by Customer-controlled AI Agents.

 

13. MODEL CHANGES

BrainPack may:

  • upgrade models;
  • downgrade models;
  • replace models;
  • discontinue models;
  • introduce new models;
  • modify model behavior.

Such changes may occur without notice.

BrainPack shall have no obligation to maintain any specific model, provider, version, architecture, capability, or functionality.

 

14. AI SAFETY CONTROLS

BrainPack may implement:

  • prompt filtering;
  • content moderation;
  • abuse detection;
  • risk scoring;
  • safety monitoring;
  • output controls;
  • usage restrictions.

BrainPack may modify such controls at any time.

 

15. AI IMPROVEMENT RIGHTS

To the maximum extent permitted by law, BrainPack may utilize:

  • AI Interaction Data;
  • usage metrics;
  • operational information;
  • statistical information;
  • anonymized information;
  • de-identified information;
  • aggregated information;

for purposes including:

  • service improvement;
  • AI improvement;
  • model evaluation;
  • benchmarking;
  • research;
  • analytics;
  • product development.

 

16. CUSTOMER CONFIDENTIALITY PROTECTION

BrainPack shall not intentionally disclose identifiable Customer Confidential Information to other customers.

Nothing herein restricts BrainPack from using:

  • anonymized information;
  • aggregated information;
  • de-identified information;
  • derived analytics;

for legitimate business purposes.

 

17. TRAINING OF MODELS

Unless expressly agreed otherwise in writing:

BrainPack shall not intentionally use identifiable Customer Confidential Information to train publicly available third-party foundation models.

This restriction shall not apply to:

  • transient inference processing;
  • operational processing;
  • AI functionality requested by Customer;
  • anonymized information;
  • aggregated information;
  • de-identified information.

 

18. AI SECURITY

BrainPack may implement safeguards designed to protect AI-enabled systems, including:

  • access controls;
  • monitoring;
  • logging;
  • anomaly detection;
  • provider assessments;
  • security reviews.

BrainPack does not guarantee that AI systems are immune from:

  • prompt injection;
  • adversarial attacks;
  • model abuse;
  • data extraction attempts;
  • security incidents.

 

19. REGULATORY COMPLIANCE

BrainPack may modify AI Services as necessary to comply with:

  • AI regulations;
  • privacy laws;
  • cybersecurity laws;
  • export controls;
  • governmental requirements.

BrainPack reserves the right to restrict or discontinue AI functionality where necessary for compliance purposes.

 

20. AI AUDITABILITY

BrainPack may maintain records concerning:

  • AI usage;
  • AI interactions;
  • system activity;
  • safety events;
  • security events;

for operational, compliance, security, and improvement purposes.

 

21. NO REPRESENTATIONS REGARDING REGULATORY STATUS

BrainPack makes no representation that:

  • AI Output is legally compliant;
  • AI Output satisfies regulatory requirements;
  • AI Output satisfies professional standards.

Customer remains responsible for determining suitability and compliance.

 

22. FUTURE TECHNOLOGIES

This AI Notice shall apply not only to currently available AI technologies but also to future technologies that may be integrated into the Services.

References to AI technologies shall be interpreted broadly to include successor technologies.

 

23. CHANGES TO THIS AI NOTICE

BrainPack may modify this AI Notice at any time.

Updated versions become effective upon publication or as otherwise communicated.

Continued use of AI-enabled Services constitutes acceptance of the updated AI Notice.

 

24. GOVERNING LAW

This AI Notice shall be governed by the laws of the Republic of Cyprus.

 

25. JURISDICTION

The courts of Cyprus shall have exclusive jurisdiction regarding disputes arising from this AI Notice.

 

FINAL ACKNOWLEDGEMENT

By using BrainPack Services, Customer acknowledges and agrees that:

  • BrainPack may utilize Generative AI;
  • BrainPack may utilize Large Language Models;
  • BrainPack may utilize AI Agents;
  • BrainPack may utilize current and future AI providers;
  • BrainPack may modify AI technologies without notice;
  • AI Output may contain inaccuracies;
  • Human review remains Customer's responsibility;
  • BrainPack may use anonymized, aggregated, statistical, and de-identified information to improve AI systems and Services.
